1. Who we are
DigiFlipper ("we", "us", "our") is operated by TouringTunes sp. z o.o., a company registered in Poland (KRS [NUMBER], NIP [NUMBER], REGON [NUMBER]), with registered office at [ADDRESS].

2. What DigiFlipper is
DigiFlipper is a software-as-a-service product that:
- Reads public marketplace and metadata signals (Discogs, Bandcamp, Spotify, TikTok, news, Wikidata) to forecast vinyl record price movements.
- Lets users sync their Discogs collection or marketplace inventory for price intelligence and alerts.
- Provides forecast scores, price bands, and event-triggered alerts ("Service").
DigiFlipper is not a marketplace, broker, or financial advisor. We do not buy or sell records on your behalf and we do not modify any data on Discogs or other third-party services.
3. Eligibility & account
You must be at least 16 years old to use the Service. By creating an account, you confirm you meet this requirement.
You are responsible for keeping your account credentials secure. Tell us immediately if you suspect unauthorized use of your account.
4. Forecast disclaimer (important)
Our forecasts are informational, not financial advice.
Price forecasts are statistical estimates based on public signals. Vinyl record prices are influenced by many factors we cannot observe. We do not guarantee any particular price outcome, return, or profitability.
You are solely responsible for any buy, hold, or sell decision you make based on our forecasts. Do not use the Service as the only basis for material financial decisions.
5. Acceptable use
You agree not to:
- Use the Service to violate Discogs', Bandcamp's, or any other third-party platform's Terms of Service.
- Re-sell, sublicense, or expose our forecasts as your own product without a written commercial agreement with us.
- Scrape, reverse-engineer, or extract data from the Service in bulk beyond what your subscription tier allows.
- Use the Service to harass other users or distribute illegal content.
- Bypass authentication, rate limits, or attempt to access data of other users.
We reserve the right to suspend or terminate accounts violating these rules, with or without prior notice.
6. Subscriptions & billing
Tiers
- Casual — Free, no payment required.
- Investor — €29 / month, billed monthly. 14-day free trial, no card required upfront.
- Dealer — €99 / month per store. Custom pilot terms apply.
Trials
Investor includes a 14-day free trial. You may cancel during the trial with no charge. After the trial, the subscription renews at €29 / month unless cancelled.
Renewal
Paid subscriptions renew automatically each month at the then-current price. We will send you an email notice at least 7 days before any price change.
Cancellation
You may cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for unused days of the current period, except where required by law (EU consumer law: within 14 days of first paid subscription, full refund on request unless you have used the Service substantially).
VAT
Prices are exclusive of VAT. EU consumers pay local VAT at checkout. Business customers may provide a valid VAT number to enable reverse charge.
Payment processor
Payments are processed by Stripe Inc. (and/or Paddle, depending on the launch tier). We do not store full payment card details.
7. Your data
We process your data per the Privacy Policy. Short version:
- Email, account profile, and authentication data — held to provide the Service.
- Discogs Personal Access Token — encrypted at rest using Supabase Vault. Used only to read your collection. Revoked on disconnect.
- Synced inventory metadata — stored in our EU-hosted database. Exported on request. Deleted within 30 days of account closure.
- Subprocessors — listed in the Privacy Policy.
You retain ownership of your collection data. We claim no IP rights over your records or listings.
8. Our IP
Our forecasts, scoring methodology, signal definitions, source code, UI, brand assets, and documentation are owned by TouringTunes sp. z o.o. You receive a non-exclusive, non-transferable license to use the Service for your own (or your store's) operations during the subscription period.
9. Third-party services
The Service depends on third-party data sources (Discogs, Bandcamp, Spotify, Songstats, etc.). Their availability is outside our control. If a third-party service becomes unavailable, we may reduce features on affected tiers without notice. We will communicate any material service degradation by email.
10. Availability & SLA
We aim for 99.5% monthly uptime on the Investor and Dealer tiers, measured at the digiflipper.com and app.digiflipper.com endpoints. This is a target, not a service-level guarantee. Casual tier has no SLA.
Planned maintenance windows are announced at least 24 hours in advance.
11. Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is", without warranty of any kind beyond what is implied by mandatory consumer law.
- We are not liable for indirect, incidental, or consequential damages — including but not limited to lost profits on resale decisions influenced by our forecasts.
- Our aggregate liability for any direct damages in any 12-month period is limited to the amount you paid us in that period.
Nothing in this section limits liability that cannot be limited under applicable law (gross negligence, fraud, death/personal injury).
12. Termination
We may suspend or terminate your account if you breach these Terms or fail to pay. We will give you reasonable notice except where immediate action is required (security, legal compliance).
You may close your account anytime via settings. We will delete your data within 30 days of account closure, subject to legal retention obligations.
13. Changes to these Terms
We may update these Terms. Material changes will be communicated by email at least 14 days before the effective date. Continued use of the Service after the effective date constitutes acceptance.
14. Governing law & disputes
These Terms are governed by Polish law. EU consumers retain the protections of the mandatory consumer law of their country of residence.
Disputes will first be addressed informally — write us at support@digiflipper.com. If informal resolution fails, EU consumers may use the European Commission's Online Dispute Resolution platform. Other disputes will be resolved in the courts of [CITY, POLAND].
